Judge in Penn State hazing case orders trainer Tim Bream to court
Judge Allen Sinclair granted the request, and a hearing of contempt is scheduled for August 30.
Some of the accused 16 members of Beta Theta Pi are charged with involuntary manslaughter and aggravated assault for the February death of sophomore Timothy Piazza, 19.
Defense lawyers asked Sinclair to enforce a subpoena against Bream, saying they have not been able to serve it on him directly despite efforts to find him or reach him through his attorney, university lawyers or the building where he works.
He said he made multiple attempts, from over a month, to serve Bream a subpoena for the preliminary hearing.
Kelly said Bream's role brings the charges brought against Heimer into question, while Parks Miller countered it merely means Bream could face charges if there is evidence to support the allegations, pennlive reported.
She noted that as the manager, her client had access to the surveillance equipment "closet" in the Beta Theta Pi fraternity house.
Although a contempt hearing is issued, Bream would have the right to plead the Fifth Amendment. Judge Sinclair, who has presided over the tense and often volatile proceedings since June, will decide if the brothers will go on trial after closing arguments scheduled for August 31 and September 1.
Bream was aware of the bid acceptance night and had watched from a balcony as the brothers led the pledges to the "gauntlet", Scicchitano testified during cross examination on Thursday.
Scicchitano, earlier on Thursday, testified that video captured by a basement camera at a Penn State fraternity was deleted two days after Piazza died.
Parks Miller shot down that claim, stating that the investigation into the deleted footage is a new investigation and would result in new charges.
