In October, a former employee named Jorge Ferrofiled a wrongful termination suit, alleging that not only did he suffer racial discrimination, but also taunts for being gay, including threats of violence.
According to The Washington Post, the lawsuit was filed on behalf of Marcus Vaughn, a former employee at the Fremont factory from April 23 to October 31, who alleged that employees and supervisors regularly used the N-word around him and other black colleagues.
Per Bloomberg, the lawsuit also claims it's a "hotbed for racist behavior".

Vaughn stated that although the company is considered an innovative company and the pioneer of the electric auto revolution, its standard operating procedure "is pre-Civil rights era race discrimination". According to Vaugh, this came after he filed a complaint to human resources and Musk about Tesla employees repeatedly using racial epithets around him and his black co-workers in the plant.
Vaughn's lawsuit is seeking class-action status and unspecified damages under California's anti-discrimination law. On Tesla's most recent earnings call, Chief Executive Officer Elon Musk acknowledged that the company recently fired about 700 workers for low performance.
Tesla responded to the lawsuit by saying that it takes 'any and every form of discrimination or harassment extremely seriously'. "In fairness, if someone is a jerk to you, but sincerely apologises, it is important to be thick-skinned and accept the apology".

According to the complaint, Musk sent an email to Tesla employees in May, a month after Vaughn started work, which gave mixed messages: "Part of not being a huge jerk is considering how someone might feel who is part of [a] historically less represented group", the suit claims the email said. "Sometimes these things happen unintentionally, in which case you should apologize".
