Hit-and-run driver tried to get away — then a man took out a sledge hammer, video shows | Miami Herald

Police were able to arrest the unidentified driver, according to the Miami Herald.

But police said Lagutenko failed to stop and the officer backed off because of the Miami Police Department's no-chase policy for non-violent crimes.

Then, a man wearing a dark shirt, khaki cargo shorts and black shoes with white socks gets out of a auto and uses a sledgehammer or mallet to smash the SUV's windows.

In the video, the driver in a wrecked silver Infiniti SUV, tries to reverse from the scene of the crash. Cell phone video shows the driver reversing and trying to leave the scene.

"That's insane. You know, you have a crash, you stop", witness Anthony Jimenez said. They attempt to pull the man from his vehicle, and one even screams, "Don't move".

With the guy swinging away and breaking Lagutenko's windows, the hit-and-run driver eventually weaved his way through traffic and got away.




Multiple drivers can be seen in the video trying to stop the SUV from leaving.

Maxwell Lagutenko, 25, was later charged in the crash that happened near Northeast 34th Street.

But cops warned others not to repeat the actions of the vigilante drivers who ganged up on the SUV should they find themselves in a similar situation, and dial 911 instead.

Jimenez, who called the police, said the man with the sledgehammer went too far.

Lagutenko's charges include eluding and fleeing from a police officer and reckless driving.

Police also used the incident - in regards to the person taking a hammer to the auto - not to take the law into their own hands.
