Jury selection in Missouri governor's trial to enter 3rd day

15 May 2018, 09:18 | Devin Moran

Criminal case dropped against sitting US governor

Defense attorney Scott Rosenblum leaves the Civil Courts building in downtown St. Louis on May 10 the first day of jury selection in Governor Eric Greitens felony invasion of privacy trial

The trial of Missouri Gov. Eric Greitens was halted Monday, the third day of jury selection, but officials said they will refile the felony invasion of privacy case using a special prosecutor.

The prosecutor dropped the felony charge against Greitens after the judge in the case ruled that the defense would be allowed to call Gardner to the witness stand. Defense lawyers accused Gardner of misconduct in the case and said she made herself a witness to the perjury of a lead investigator.

"It does appear that a couple individuals seek any opportunity to attack me, and in this case are seeking to punish the hard-working journalists that work at the Missouri Times to do so", Faughn said.

'I have emerged from it a changed man'. Instead, attorneys were still working through the first phase of jury selection as Greitens' attorneys methodically questioned people about their beliefs.

The governor has been charged with criminal invasion of privacy after an unidentified woman that Greitens admitted to having an affair with said he blackmailed her with inappropriate photos.

Greitens, who has long denied any criminal wrongdoing, walked out of the courthouse Monday with at least a momentary vindication.

A Missouri House special committee is investigating all of the allegations against Greitens, and is expected to make a report laying out their recommendations, which could include the governor's impeachment.

Last month, prosecutors brought an unrelated charge of computer tampering against the governor, alleging he obtained and transmitted the donor list without the charity's consent for his own political gain.

The special House investigative committee looking into Governor Eric Greitens canceled what would have been its second public meeting ever.

The prosecutor continued, "While the court has other remedies ... it has chosen not to [use them.] When the court and the defense team put the state in the impossible position of choosing between her professional obligations and the pursuit of justice, the Circuit Attorney will always choose the pursuit of justice".

Greitens' attorney Scott Rosenblum has been particularly focused on any potential jurors with preconceived opinions, even those who have said under repeated questioning that they could be objective and unbiased while hearing testimony. But before Gardner's announcement, some Democrats were concerned that not trying to throw [out] Greitens earlier would have consequences.

Prosecutors say they hope to refile the case.

In response, the committee issued subpoenas to Greitens campaign fund, his Georgia-based campaign adviser Austin Chambers and A New Missouri Inc., the dark money nonprofit formed to promote Greitens' agenda. However, Greitens quickly moved on to asking "people of goodwill to come together so that all of us can continue to do good together" (assuming that he isn't removed from office or found guilty of a separate felony). "She also objected to other large categories of documents", said Barnes, R-Jefferson City. The members of the House committee have discovered a disturbing pattern of allegations, most of which are completely separate from the case dismissed today.

House investigatory committee chairman Jay Barnes said it's considering its options for how to enforce the subpoena. Among other things, they accused Tisaby, a former Federal Bureau of Investigation agent, of lying when he said he did not take notes when he and Gardner on January 29 interviewed the woman involved in the affair. "The governor has lost the moral authority and the ability to lead the state going forward, and we reaffirm our call that he resign immediately".
