Clinics Sue Iowa Over Six-Week Abortion Ban

Pro-choice groups challenge Iowa's strict abortion ban

Planned Parenthood and the ACLU of Iowa filed a lawsuit against the so-called "heartbeat law".

The "heartbeat" bill passed the Iowa House and Senate earlier this month and was signed by Iowa Gov. Kim Reynolds soon after. They say the state constitution, not the U.S. Constitution, guarantees a woman's right to abortion.

Abortion-rights groups said Tuesday that they had filed a lawsuit challenging the nation's most restrictive abortion law, an Iowa provision that bans most abortions once a fetal heartbeat is detected, around the sixth week of pregnancy.

Shortly after the announcement of the lawsuit, Iowa's longtime attorney general said he would not defend the law.

"In the 45 years since Roe, no federal or state court has upheld such a unsafe law", said ACLU of Iowa Legal Director Rita Bettis.

"We knew there would be a legal fight, but it's a fight worth having to protect innocent life", Smith said in an email.

Iowa Republicans previous year also gave up millions in federal dollars to create a state-funded family planning program that prohibits participation from abortion providers such as Planned Parenthood.




Gov. Reynolds' spokesperson Brenna Smith said the state will be represented by the Thomas More Society "at no cost to taxpayers".

A hearing on the temporary injunction is expected in the next few weeks. In June 2015, the Iowa Supreme Court ruled that "the Iowa Constitution protects a woman's right to terminate her pregnancy to the same extent as the United States Constitution".

Similar lawsuits are underway in MS, which passed a ban on abortion after 15 weeks, and Kentucky, which banned abortions after 11 weeks. Earlier versions had called for felony charges against doctors, but not women seeking an abortion.

Separately, a new Iowa-based coalition of anti-abortion organizations was formed a year ago to renew efforts toward an abortion ban.

If the ban takes effect, Iowa women would have to travel out of state to obtain an abortion after a fetal heartbeat is detected.

Planned Parenthood officials say their organization along with the ACLU and the Emma Goldman Clinic in Iowa City are in it for the long haul. "We will not back down until every person has the freedom and opportunity to make the health care decisions that are best for them and their families". "This law must be struck down". A challenge against the 72-hour law is now pending before the Iowa Supreme Court. Critics have pointed out that the legislation would effectively ban abortion at six weeks and before a woman is aware she is pregnant.

Abortion opponents hope such a lawsuit could bring the divisive abortion issue back before the U.S. Supreme Court in the belief that the 5-4 conservative majority could curtail abortion access or ban it outright.
