Silva has claimed that Frances gave the instrument to him as a wedding gift, something she has denied in the past.
Although Frances Bean's divorce from Isaiah Silva was finalized last November, the question of the ownership of Kurt's 1959 Martin D-18E had still not been determined until now.
Throughout the former couple's divorce proceedings, the rightful owner of the guitar had always been a point of dispute and discord. She will not have to pay any spousal support and will also receive the LA house they owned together. In 2014, one such theorist, Richard Lee, sued the city of Seattle over the sealed status of images taken at the scene, believing that Cobain was killed by government officials.
However, the Seattle court of appeals ruled in favour of Frances Bean Cobain and her mother, Courtney Love, who subsequently sought a ruling against Lee's attempt and "permanently enjoining the City from disclosing, disseminating, releasing, or distributing any death-scene photographs not previously disclosed".
The court ruled the photographs are exempt from Washington state's Public Records Act and releasing the photos would "violate the Cobain family's due process rights under the 14th Amendment of the United States Constitution".
The couple had been together for roughly five years and married for less than two when Frances made a decision to file for divorce back in March 2016. "You know, the bottom line is there's absolutely no evidence to suggest that Kurt's death was anything other than suicide, and it's nearly absurd that the topic continues to come up".
Though Frances Bean has lost the iconic piece of music history, it's clear she's forging her own way when it comes to the business, recently sharing her first ever original song and suggesting she is set to release her own music.
