Bishop then put the gun back in his trousers and walked away with his hands up.

29-year-old Chase Bishop, whose extremely cool white-boy shimmy skated so very close to tragedy, has now officially been arrested and charged with second-degree assault.

Chase Bishop is pictured in this undated photo released by the Denver Sheriff's Department.

The gun fired as he went to pick it up, hitting a man in the crowd, Tom Reddington, in the leg. Denver police had said they were awaiting the results of alcohol and drug tests before making an arrest.

A former Federal Bureau of Investigation agent told 9NEWS that an agent who accidentally discharges a weapon will be automatically suspended for three days without pay.

FBI Agent Chase Bishop was booked on suspicion of second-degree assault after his service pistol fell from his trousers while he was dancing in a nightclub.

"In order to preserve the integrity of the ongoing investigation, we are unable to comment regarding this matter", she said in statement.

"The FBI will continue to fully cooperate with the Denver Police Department and the Denver District Attorney's Office as this matter proceeds through the judicial process", Sanders said. Bishop then places the gun in his waistband and walks off the dance floor with his hands in the air. That bullet struck a man in the leg, leaving him with serious but non-life-threatening injuries.

He has not been formally charged by the Denver DA's Office. "Then it clicked that I've been shot".

"We sat down at one of those picnic tables - I heard a loud bang and I thought some idiot set off a firecracker", Reddington told ABC News later.

Mile High Spirits said on its Facebook page that the bar's management was "deeply saddened" by the incident.
