Prosecutors are considering 13 charges against Treu, including four counts of homicide by intoxicated use of a motor vehicle. She was with her biological parents, the paper reported, but she had been removed from their home in September and placed in the foster home.
Treu was "somewhat out of it", the passenger said, and grabbed the wheel back, drove off the roadway and struck the group, Newell said.
He said that when the baby cried, the girl panicked and stomped on his head.
Police questioned one adult and three children who were present at the day care center.
The other charges Treu faces are for felony bail jumping, intentionally abusing a hazardous substance, and causing "great bodily harm" during a hit-and-run because another Girl Scout in the group was injured. The truck was found to be abandoned in the garage at this location and the driver and a passenger had left the house prior to police arriving.
Treu appeared via video in court Tuesday afternoon for an initial appearances on 11 counts, including four counts of homicide.
